Article 1 – General conditions of sale
These General Terms and Conditions of Sale (“GTC”) govern all sales made by ZH, a sole proprietorship registered under SIRET 881 964 332 00038, headquartered in Villeneuve-sur-Lot, France, through the website https://www.zhcostumedesign.fr.
ZH designs, manufactures, and sells stage costumes, either as ready-made products or custom-made creations tailored to the specific requirements of both individual and professional clients.
These GTC define the rights and obligations of the parties involved in the online sale of ZH products, both in France and internationally.
Placing an order on the website implies full and unconditional acceptance of these GTC.
Article 2 – Products
The products offered for sale on https://www.zhcostumedesign.fr are stage costumes designed and handcrafted by ZH. Each product is described with the utmost care, including key features, materials used, available sizes, and, where applicable, illustrative photographs.
Photographs and descriptions are provided for informational purposes only. Despite efforts to ensure accuracy, minor variations in color, texture, or appearance may occur due to screen settings or the handmade nature of the products. Such variations shall not be considered defects or grounds for cancellation or refund.
ZH offers three types of products:
- Ready-made items, available from stock or produced in small series, ajusted with your measures
- Catalog design personnalized with your choose (Shape and color) with your measures
- Custom-made, created according to the customer’s specifications, measurements, or requests.
For custom-made products, a specific production timeframe is communicated prior to order confirmation. As these creations are made to order, they cannot be returned or refunded, except in the event of a proven manufacturing defect.
ZH strives to ensure product availability. However, in the event of stock shortages or temporary unavailability, ZH will inform the customer as soon as possible.
The customer may then choose to:
- wait for restocking,
- modify the order,
- or cancel the order and receive a full refund of the amount paid.
Article 3 – Prices and Payment Terms
The prices of the products offered on the website https://zh-costume-design.myshopify.com/ are indicated in euros (€), all taxes included (VAT), excluding shipping fees.
Shipping costs are specified before the final validation of the order and are added to the total amount payable.
For sales made outside the European Union, customs duties, import taxes, or additional fees may apply and are the responsibility of the customer, in accordance with the legislation of the destination country. ZH is not liable for these additional charges, which remain solely the buyer’s responsibility.
ZH reserves the right to modify its prices at any time; however, products will be invoiced based on the prices in effect at the time the order is confirmed.
Payment Terms:
Payment is due in full at the time of ordering.
The customer may complete payment using the following methods:

All transactions are secured through the online payment systems used by ZH. The customer's banking data is never stored or accessible to ZH.
The order will only be considered final after the payment has been successfully processed. In case of non-payment, ZH reserves the right to suspend or cancel any ongoing order.
Article 4 – Orders and Confirmation

The customer may place an order for the products offered on the website https://zh-costume-design.myshopify.com/ by following the online process provided for this purpose.
Before final validation, the customer has the opportunity to review the details of their order, the total price, and to correct any possible errors.
The order will be considered firm and final only after:

Validation of the shopping cart and the customer’s personal information;

Explicit acceptance of these General Terms and Conditions of Sale (GTCS);

Full payment of the amount due.
Once the order has been validated and payment confirmed, ZH sends the customer a confirmation email summarizing the order, the total amount paid, and the estimated delivery or production times (in the case of a custom-made order).
ZH reserves the right to refuse or cancel any order from a customer with whom there is an existing dispute concerning payment of a previous order, or in the event of suspected fraud.
For custom-made orders, the customer is required to provide accurate information (measurements, preferences, instructions). Any error or omission in this information shall not be the responsibility of ZH.
Once production has begun, such orders cannot be cancelled or modified without prior agreement from ZH.
Article 5 – Delivery
EN:
Products are delivered to the address provided by the customer at the time of ordering. It is the customer’s responsibility to ensure the accuracy of the information provided. ZH cannot be held liable for any delivery failure resulting from an error or omission in the recipient’s contact details.
Delivery Times
For finished products, orders are generally shipped within 3 to 10 business days after payment confirmation, depending on stock availability.
For custom-made orders, a specific production time is communicated before the final validation of the order.
These timeframes may vary depending on destination, workload periods, and transport conditions. In the event of a foreseeable delay, the customer will be informed by email.
Shipping Fees
Shipping fees are calculated based on the weight, volume of the package, and the destination country. They are specified before the order is confirmed.
Deliveries are handled by professional carriers (e.g., La Poste, Colissimo, Chronopost, DHL, UPS, etc.), depending on the available options.
Risks and Receipt
Products travel at the carrier’s risk. Upon delivery, the customer must check the condition of the package and the products.
In case of damage, partial loss, or any irregularity, it is the customer’s responsibility to immediately make the necessary reservations with the carrier and inform ZH within 48 hours after receipt.
ZH cannot be held responsible for delays or losses attributable to the carrier, customs services, or events of force majeure (natural disasters, strikes, blockages, etc.).
Article 6 – Right of Withdrawal and Returns
EN:
In accordance with Articles L221-18 and following of the French Consumer Code, the consumer customer has a period of 14 days from the date of receipt of the product to exercise their right of withdrawal, only for standard, non-modified products.
⚠️ However, the right of withdrawal does not apply in the following cases:

Products made to measure, produced according to the customer’s specifications or measurements;

Products customized at the customer’s request (choice of fabrics, colors, decorations, size adaptations, etc.);
-
Finished products that have undergone any adjustment or alteration based on the customer’s measurements, even minimal.
Consequently, all custom-made, personalized, or adjusted costumes cannot be returned, exchanged, or refunded, except in the event of a proven manufacturing defect attributable to ZH.
For standard, non-personalized products, the customer may exercise their right of withdrawal within 14 days after receipt by contacting ZH by email at: zhcostumedesign@outlook.com
The product must be returned in its original condition, unworn, unwashed, and unaltered.
Return shipping costs remain the responsibility of the customer.
Once the product has been received and inspected, ZH will issue a refund of the amount paid (excluding shipping fees) within a maximum of 14 days.
No refund will be granted for products that are damaged, worn, or altered after delivery.
Article 7 – Statutory Warranties and Liability

The products sold on the website https://zh-costume-design.myshopify.com/ benefit from the statutory warranties provided under French law:
Legal Warranty of Conformity
(Articles L217-3 to L217-17 of the French Consumer Code)
The seller must deliver a product that complies with the contract and is responsible for any defects existing at the time of delivery.
The customer has two years from the date of delivery to take action.
Warranty Against Hidden Defects
(Articles 1641 to 1649 of the French Civil Code)
The seller is liable for hidden defects that render the product unfit for its intended use.
The customer has two years from the discovery of the defect to take action.
In the event of non-conformity or a manufacturing defect, the customer must contact ZH by email, providing a description of the issue and attaching photos if necessary.
After verification, ZH may offer the customer:

repair of the product,

replacement of the product,
-
or, if neither is possible, a refund.
Exclusions
No warranty will apply in the following cases:

normal wear and tear of the product,
-
deterioration resulting from improper use, lack of maintenance, or unauthorized modification,
-
damage caused by an accident, negligence, or use contrary to the intended purpose of the product.
Liability
ZH cannot be held liable for indirect damages (such as loss of business, loss of opportunity, or intangible harm) resulting from the purchase or use of its products.
ZH shall also not be held responsible in cases of force majeure or events beyond its control.
Article 8 – Intellectual Property

All elements appearing on the website https://zh-costume-design.myshopify.com/ — including, but not limited to, texts, photographs, drawings, sketches, creations, designs, logos, trademarks, and other visual or audio content — are the exclusive property of ZH or are used with specific authorization.
Any reproduction, representation, distribution, modification, or exploitation, whether partial or total, of the website content or ZH’s creations, by any means whatsoever, without prior written authorization, is strictly prohibited and constitutes an act of infringement under the French Intellectual Property Code.
Custom-made costumes and creations produced by ZH remain the intellectual and artistic property of their creator, even after their sale.
The purchase of a ZH costume or product does not grant any rights of reproduction, distribution, or commercial use of its design, image, or model, unless expressly authorized in writing.
The customer agrees not to use ZH products or visuals in any way that may infringe upon the brand’s intellectual property rights or reputation.
ZH reserves the right to take any necessary legal action in the event of a violation of its rights.
Article 9 – Personal Data Protection
EN:
As part of its business activity, ZH collects and processes personal data concerning its customers (name, surname, address, email, phone number, delivery and payment information).
This data is necessary for managing orders, delivering products, and issuing invoices.
ZH is committed to handling this information confidentially and using it solely for the purposes for which it was collected.
No personal data will be shared with third parties, except when required for the execution of the contract (e.g., carriers, payment service providers).
The website https://zh-costume-design.myshopify.com/ complies with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the French Data Protection Act of 6 January 1978 as amended.
Customer Rights
In accordance with applicable regulations, every customer has the following rights:

ZH undertakes to respond to any request within a maximum of 30 days from receipt.
Customer data is retained for the duration necessary for managing the commercial relationship and fulfilling legal obligations (accounting, taxation, warranty).
The website may use cookies to enhance user experience (navigation analysis, shopping cart, preferences). The customer may configure their browser to accept or refuse cookies.
Article 10 – Applicable Law and Dispute Resolution

These General Terms and Conditions of Sale (GTCS) are governed by French law, regardless of the customer’s country of residence or the place of delivery of the products.
In the event of a dispute or claim, the customer agrees to contact ZH as a priority in order to seek an amicable solution.

If no amicable solution is found, the consumer customer residing in the European Union may resort, free of charge, to a consumer mediator to attempt to resolve the dispute amicably, in accordance with Articles L612-1 and following of the French Consumer Code.
The mediation procedures will be provided upon request.
In the absence of an amicable agreement or mediation, any dispute will be submitted to the competent French courts, in accordance with the applicable rules of jurisdiction.
For professional clients, the courts within the jurisdiction of ZH’s registered office shall have exclusive competence.
In the case of international sales, it is expressly agreed that only the French version of these GTCS shall prevail in the event of interpretation or dispute.
